PUBLIC OFFERING CONTRACT

The public offer contract, in accordance with the Civil Code of the Republic of Armenia, is a public contract for the provision of services through the website www.2020bus.com, which defines the relationship between the "Hayreniq Tour" passenger transport company (hereinafter referred to as the Carrier) and any users of the website (hereinafter referred to as the User/s). , which accepted the public offer (hereinafter - the offer).

Acceptance of an Offer is any action by the User, in particular, but not exclusively, registration/authorization on the Site, placing an order for services, paying for services, leaving feedback and any other use of the Site.

DEFINITIONS:

Public offer - a public offer of passenger transportation by "Hayreniq Tour" company, addressed to an unlimited number (individuals and/or legal entities) to conclude a contract on the same terms and conditions set for in this public contract (offer) and for the provision of passenger and luggage transportation services through the website.

Acceptance of the Offer - Full, unconditional acceptance of the terms of the Public Offer by the User by taking any action to use the website. Any use of the website means that the user is familiar with the terms of the offer, agrees with it, understands and accepts the terms without reservations or exceptions. In case of disagreement with any of the terms of the offer, the User has no right to use the Website and is obliged to stop using it.

The website is an Internet resource located at the Internet address www.2020bus.com with all its functionality, pages, graphics, etc., intended for obtaining the services of vehicle search, route, seat availability, registration, reservation, sale of travel documents (tickets) .

Website user: any legally capable individual, individual entrepreneur and/or his representative, representative of a legal entity, who has accepted the terms of the offer and uses the website.

The carrier is a legal entity, the passenger transport company "Hayreniq Tour", which directly provides services for the transportation of passengers and luggage by road and cooperates with other legal entities and individuals through partnership, mediation and other agreements with entrepreneurs.

A passenger is a physical person who has a travel document (ticket) in his name, who intends to use or has used the transport services provided by the carrier.

A travel document (ticket/digital voucher/boarding document, etc.) is a visual form of an electronic travel document created by the website, which contains the necessary information about the transport service (route, date and time, service cost, etc.) is an agreement between the carrier and the passenger and grants the passenger the right to use the transportation service.

Baggage is cargo that is allowed to be transported by minibus, the dimensions and weight of which are defined by this offer.

1. SUBJECT OF THE CONTRACT

1.1. Under this Agreement, the carrier undertakes to provide passenger and baggage transportation services with advance payment by the Website User/Passenger in accordance with the requirements of the current legislation of the Republic of Armenia and the terms of this public offer.

2. TERMS OF PROVIDING PASSENGER AND CARGO TRANSFER SERVICES.

2.1 General conditions and procedure for obtaining a travel document.

2.1.1. Passenger and baggage transportation services are provided by the carrier solely on the basis of a travel document (ticket).

2.1.2. A travel document (ticket) is a transportation contract concluded between a passenger and a carrier, on the basis of which the passenger has the right to use the mean of transport and related services exclusively on the flight specified in the travel document (ticket).

2.1.3. The travel document (ticket) is valid from the moment of payment until the date and time of arrival at the destination indicated on it.

2.1.4. The travel document (ticket)is created after registration and payment by the Website User/Passenger on the Carrier's website by the electronic system for booking and selling travel documents (tickets) and is sent to the website user/passenger's e-mail address.

2.1.5. After receiving a travel document (ticket), the Passenger must immediately check the accuracy of the data indicated on it, as well as the conformity of the ticket price with the amount paid. Claims submitted later will not be accepted.

2.1.6. The website user, who has booked or purchased a travel document (ticket) and carrier services using the website, confirms that he has read and unconditionally accepts the terms of this public offer.

2.1.7. If the user of the Website is not a passenger, when making a reservation and payment for services, he confirms that he is the authorized person of the Passenger, in whose name the reservation and payment of services are made and is obliged to inform the passenger about the terms of services and other information necessary for the passenger to receive transport services.

2.1.8. The passenger, having received a travel document (ticket) in his name, confirms that he is aware of the terms of this Public Offer and accepts them unconditionally.

2.1.9. The passenger must arrive at the boarding point at least 20 minutes before the departure of the minibus. The passenger, having entered his luggage in the trunk, must present all the necessary documents and hand luggage to the representative of the Carrier (driver, controller, etc.), who in turn will decide the seat of the passenger in the minibus. If the seat number is not indicated in the travel document (ticket) taking his seat, the Passenger must not interfere with the boarding of other Passengers.

2.1.10. In the absence of a passenger boarding a minibus at the time and place specified in the ticket, the contract for the provision of transport services at the initiative of the Passenger is considered terminated, and the carrier reserves the right to sell the travel document (ticket) for an empty seat.

2.1.11. The departure date can be changed 2 (two) times free of charge. It is possible to change the departure date only if there is free space in the minibus.

2.1.12. When changing the departure date, the passenger must pay the difference between the original ticket price and the new ticket price, if the rescheduled date ticket is more expensive. If the price of the ticket on the rescheduled date is lower than the price of the previous one, the difference in the price of the ticket will not be returned to the passenger.

2.1.13. If the passenger violates the visa regime (expiration of visas, replacement of passport with another document, etc.), the carrier reserves the right not to transport the passenger. The passenger is not given monetary compensation for an unused ticket.

2.1.14. During international road transport, the passenger must have the proper documents necessary to enter the country along the route.

2.1.15. If the passenger does not comply with the customs and border rules and is detained at the border, and this leads to a flight delay, the minibus crew has the right to leave the border without the passenger according to the minibus schedule and without compensation services.

2.1.16. The carrier is not responsible for delays during the journey and untimely arrival at the destinations, if this is due to circumstances beyond its control (including delays at customs borders, weather conditions, traffic jams, actions of government bodies, road repairs, etc., which are affected by the actions of the passengers themselves on the fulfillment of these circumstances) and other reasons.

2.1.17. In case of non-delivery of additional services provided by the carrier (hot or soft drinks, light snacks, newspapers, magazines, watching movies, WI-FI, USB sockets, pillows, blankets, toilet, air conditioner, etc.), the passenger has the right not to compensate the cost of these services.

2.1.18. In the event of a dispute between Passengers regarding the temperature settings of the air conditioner in the vehicle (minibus or minivan), the passengers with the majority of opinions will have priority.

2.1.19. Poor cooling of the air conditioner in the car cabin (minibus or minivan) is associated with a section of road with mountainous terrain following the route.

2.1.20. The carrier has the right to install video surveillance systems inside the vehicle (minibus or minivan) to ensure round-the-clock security of passengers in accordance with the UN Geneva Convention against Transnational Organized Crime and the Council of Europe Convention against International Terrorism and Trafficking in Persons.

2.1.21. If a Passenger has a high body temperature or signs of an acute respiratory viral infection, the carrier has the right not to allow such a Passenger to board an ordinary minibus (minivan) in order to protect the health of other passengers. In exceptional cases, boarding may be permitted only with a protective mask or respirator.

2.1.22. The carrier has the right to: limit or suspend carriage in the event of a natural disaster, epidemic or other emergency; stop the movement of the vehicle (minibus) if there is a threat to the life and health of passengers.

2.1.23. Passengers have the right to leave all complaints, suggestions and remarks regarding the provision of services in the Book of Complaints and Suggestions.

2.1.24. According to the Law of the Republic of Armenia "On Protection of Personal Data", the carrier does not provide information about passengers.

2.2. Rules of conduct on the bus

2.2.1. Smoking, drinking alcoholic beverages and drugs are prohibited while driving in the minibus.

2.2.2. A minibus driver may refuse to transport a passenger who is drunk, has dirty clothes, disturbs the peace or poses a danger to other passengers.

2.2.3. It is strictly forbidden to walk around the hall or stand in the corridors while the Minibus is in motion.

2.2.4. During travel is prohibited to put your feet on the seat, lie on the seats or on the floor of the minibus.

2.2.5. If the minibus is equipped with seat belts, the passenger is obliged to fasten them and use them in accordance with their purpose.

2.2.6. It is strictly forbidden to take food (including ice cream, sunflower seeds, etc.) while driving the minibus or at stops.

2.2.7. During the trip, passengers can be invited to watch movies or listen to music. Considering the diversity of Passengers' tastes and views, the Carrier reserves the right to select movies and music, but may take into account the opinion of Passengers.

2.2.8. Garbage should be placed in separate bags and thrown into the parking lot trash cans.

2.2.9. When the minibus is parked, before leaving the seat, the Passenger must make sure that the back of the seat is in an upright position.

2.2.10. It is strictly forbidden to distract the driver while driving.

2.2.11. If the passenger violates or fails to comply with the rules of conduct in the minibus, the Carrier reserves the right to remove the passenger from the flight without monetary compensation for the cost of the travel document (ticket).

2.3. Rules

2.3.1. One passenger is entitled to free transportation. Baggage occupying 1 (one) place 60x40x40 cm in size, total weight up to 30 kg. Hand luggage weighing up to 7 kg, which occupies 1 (one) place. Hand luggage is considered a bag that is easily portable and can be placed under or above the passenger seat.

2.3.2. If the luggage is larger than 60x40x40 cm and weighs more than 30 kg, it can be accepted for transportation if there is free space in the trunk of the minibus and for an additional fee.

2.3.3. The Carrier is not responsible for the storage of the Passenger's personal belongings and hand luggage.

2.3.4. The transportation of additional luggage is possible only if there is free space in the trunk of the minibus and is subject to a separate payment. Additional baggage must not exceed the size and weight of the main baggage. Free space in the luggage compartment is determined by the driver when boarding, taking into account the total number of passengers in the minibus, distribution by city and other factors.

2.3.5. The carrier is responsible only for the baggage that it accepted for carriage, that is, the passenger was given a document confirming the acceptance of the baggage (cargo tag, sticker, etc.).

2.3.6. The carrier is not responsible for any damage to breakable, perishable, improperly packed, valuable (money, documents, electronic and technical equipment, etc.) items transported in the trunk of the minibus.

2.3.7. Carrier is not responsible for minor or superficial damage to Checked Baggage carried in the hold of a minibus, in particular broken wheels and handles, lost seat belts and minor damage such as cuts, scratches, bends or stains caused by normal wear and tear and use during travel.

2.3.8. Oversized items are not accepted for moving, in particular, but not exclusively, refrigerators, televisions, sofas, etc.

2.3.9. Bicycles are allowed to be carried as baggage. Bicycles are transported in the trunk of the minibus, if there is free space. Bicycles transported this way must remove the front wheel and pack separately. The bike must also be packed. A disassembled and packed bicycle counts as two or three pieces of baggage.

2.3.10. The carrier is liable for lost luggage carried in the trunk of the minibus only if it happened through the fault of the carrier, which is proven by the passenger, provided that a claim is submitted no later than 10 days after the departure date of the minibus.

2.3.11. It is prohibited to carry baggage that threatens the safety or health of other passengers or may damage other baggage or the vehicle.

2.3.12. The carrier is not responsible for the loss of money, jewelry, passports, securities, collections, scientific valuables and other valuables that are not in the trunk of the passenger minibus.

2.3.13. Transport of animals is possible only for small animals weighing up to 7 kg and in a specially designed box (container, carrier, etc.). Any animal transported by the carrier's minibus must be vaccinated and the passenger must have the appropriate document to that effect. Damage to animals caused by other passengers or the carrier is fully compensated to the passenger, taking into account penalties and any other costs.

2.3.14. The carrier is not responsible for the storage of forgotten items and luggage in the minibus. But it takes measures to return forgotten items to the owner by transferring them to the nearest representative office of the carrier.

2.3.15. The driver of the minibus has the right in case of doubt to ensure the safety of the journey and to comply with the customs rules, to ask the passenger to show the contents of his luggage. If the passenger refuses to comply with this requirement, then the minibus driver has the right to refuse carriage of suspicious baggage.

3. INTERNATIONAL REGULATIONS

3.1. The total cost of the service under this Agreement consists of the cost of the travel document (ticket), the cost of baggage transportation, the ticket office/service fee, etc. (hereinafter - service fee).

3.2. Payment of the cost of the services provided for in this Agreement can be made in any way: through the website, using the acquisition in cashless form, through financial institutions in cashless form, in cash at the ticket office that sells travel documents (tickets), etc.

3.3. Payment of the cost of the services provided for in this Agreement is made in the amount of 100% advance payment.

3.4. Since the website user, the passenger and the payer for the services are not always the same person, the refund is made exclusively to the payer's current account or in person, if the necessary documents are available.

3.5. Refunds for services rendered pursuant to this Agreement shall be made solely by the person to whose account payment was made, the Carrier or its partners.

3.6. The basis for the refund is the unused travel document (ticket) with all tear-off slips and other documents confirming the payment.

3.7. A passenger who does not show up or is late for a flight before departure will not be refunded the amount of the paid service.

3.8. The passenger has the right to refuse passenger and baggage transportation services and to receive the paid service cost minus the cash/service fee,if;

- more than 12 hours left to the departure time indicated on the travel document (ticket), 85% is returned;

- 2 hours from 12 to the departure time indicated on the travel document (ticket), 50% is returned.

- there is less than 2 hours left to the departure time indicated on the travel document (ticket), no refund is made.

4. RIGHTS AND OBLIGATIONS

4.1. The website user/passenger has the right to:

4.1.1. to receive timely and complete information about the terms and conditions of passenger and baggage transportation services,

4.1.2. safely receive the services provided by the carrier,

4.1.3. For the compensation of damage specified in the documents, if the carrier is at fault,

4.1.4. In case of flight cancellation by the carrier, the following compensation measures:

- travel on the next flight of the carrier or its partner to the destination,

- refund the cost of the travel document (ticket) according to the unused part of the service (for the route not taken);

4.2. The website user/passenger undertakes:

4.2.1. specify the necessary and reliable information when placing an order;

4.2.2. make payments for services in accordance with the terms of this Public Offer;

4.2.3. The passenger must arrive at the boarding point no later than 20 minutes before the departure of the bus.

4.2.4. In case of reservation and confirmation via chat, the passenger must present a ticket or indicate his name and surname.

4.2.5. The passenger is obliged to keep documents confirming the payment for the service until reaching the destination specified in the travel document (ticket).

4.2.6. The passenger is obliged to submit documents for the right to use the service (travel document) to the Carrier's representative, driver or other authorized person at their first request.

4.2.7. Before using the carrier's passenger and baggage transportation service on an international flight, the passenger must familiarize himself with the applicable border crossing rules and the list of required documents.

4.2.8. The passenger is obliged to observe the rules of transportation of passengers on international bus routes, customs and international legislation.

4.2.9. The passenger must have a valid international passport and be informed about the customs regulations of the given country.

4.2.10. Along the route, the minibus makes stops, the number and duration of which is announced by the driver. If the passenger does not observe the announced stop time, the driver has the right to continue following the route, and the passenger is obliged to move to the destination independently without compensation for the rest of the journey.

4.2.11. If the passenger does not comply with customs and border rules and is detained at the border, and this leads to a flight delay, the driver has the right to follow the route and the passenger is obliged to travel to the destination independently without compensation for the rest of the trip.

4.2.12. The passenger is obliged to treat the equipment of the bus carefully and not allow it to be damaged. In case of damage to the vehicle (minibus or minivan) or equipment of the vehicle by the passenger, the latter bears financial responsibility for the damage caused to the carrier and is obliged to compensate the material damage caused to the carrier.

4.2.13. The passenger is obliged to warn the driver of the vehicle (minibus or minivan) about signs of high body temperature and/or acute respiratory viral infection.

4.3. The carrier has the right to:

4.3.1. cancel bus flights in case of circumstances threatening the life and health of passengers or other persons, without compensation for the cost of paid passenger and baggage transportation services,

4.3.2. limit or stop the provision of passenger and baggage transportation services in the event of a natural disaster, epidemic or other emergency that the carrier could not foresee;

4.3.3. stop the movement of the vehicle (minibus) if there is a threat to the life and health of passengers or other persons,

4.3.4. change the terms of the Public Offer, including the adjustment of current tariffs, by publishing notices of such changes at www.2020bus.com;

4.3.5. engage third parties to provide services provided by this Public Offer,

4.3.6. Require the website user/passenger to abide by the terms of the Public Offer to which they have agreed in accordance with its terms.

4.4. The carrier undertakes:

4.4.1.to provide services provided by the terms of this Public Offer and the requirements of the current legislation;

4.4.2. to take measures to provide safe, comfortable and high-quality services for the transportation of passengers and baggage;

4.4.3. to compensate the damage caused to the passenger's health and property in case of his fault;

4.4.4. to take measures to keep the vehicles used for the provision of services in a technically sound condition,

4.4.5. to ensure the arrival of the minibus to pick up passengers according to the date, time and place specified in the travel document (ticket),

4.4.6. to ensure mandatory personal insurance of passengers against transport accidents in accordance with the law,

4.4.7. to provide information and advice on questions that Passengers have about using the services; formulating the order, conditions for obtaining and returning a travel document (ticket),

4.4.8. to use and store confidential information received from the Website User/Passenger on www.2020bus.com in accordance with the Privacy Policy;

4.4.9. The carrier is not responsible for the availability and proper preparation of documents for the passenger to cross the customs borders of the countries along the route.

4.4.10. The carrier is not responsible for the passenger's violation of the customs and immigration rules stipulated by the current legislation of the Republic of Armenia and other countries.

4.4.11. The carrier has the right to change the schedule, use additional minibuses, as well as change the passenger's seat in the minibus without prior agreement or notification.

5. CONFIDENTIALITY

5.1. According to this Public Offer, any information provided by the Website User/Passenger when reserving seats, purchasing, returning travel documents or ordering other services on the website is considered confidential, including but not limited to personal data, in particular: surname, patronymic, passport series and number, telephone number, email address, bank details, etc.

5.2. The User/Passenger agrees to the collection and processing of personal data by the carrier and its partners in order to provide quality services within the framework of this public offer by taking active actions by ticking the appropriate box.

5.3. The Carrier guarantees that the use of the User's/Passenger's personal data is carried out only for the purpose of providing high- quality services within the framework of this public offer, in accordance with the Privacy Policy, the requirements of Armenian, international and European legislation for personal data, in particular, the European Law "General Data Protection Regulation" (GDPR). and for the protection of the Law of the Republic of Armenia "On Protection of Personal Data".

6. FORCE MAJEURE

6.1. The carrier is released from responsibility for partial or complete non-fulfillment of the obligations under this Public Offer, if it is the result of force majeure circumstances (forces of nature, political or man-made forces, military operations or war, declaration of a state of emergency, actions of governmental bodies and adoption of acts by them, which directly prohibit, create conditions or make it impossible for the carrier to fulfill its obligations), which the Parties could not foresee, which does not depend on their will and if these circumstances directly; have affected the fulfillment of the obligations assumed by this Public Offer.

6.2. If the circumstances mentioned in clause 6.1 occur, the carrier will notify the passenger through any possible means of communication. The notification must contain information about the nature of the circumstances preventing the fulfillment of the terms of the Public Offer by the carrier, indicating the relevant documents (if any).

7. COPYRIGHT

7.1. All materials presented on the website are owned by the carrier and its partners under copyright (intellectual property). All materials posted on the site are protected by copyright (intellectual property), including but not limited to the design of the site, names, trademarks, logos, texts, rights to databases and other elements of the site.

7.2. The user of the website has no right to copy, distribute or otherwise use or reproduce the content of the website or the program code underlying it, in whole or in part, without the prior written permission of the carrier.

8. LIABILITY AND DISPUTE RESOLUTION

8.1. In case of violation of their obligations under this Public Offer, the carrier, website user or passenger shall bear the responsibility defined by this Public Offer and the current legislation of the Republic of Armenia. A violation of an obligation is considered to be its non- fulfillment or improper fulfillment, that is, fulfillment in violation of the conditions determined by the content of the obligation.

8.2. The carrier, the user of the site and the passenger are not responsible for the violation of their obligations under this Public Offer, if it was not their fault. A party is considered innocent if it proves that it has taken all measures under its control to properly fulfill the obligation.

8.3. All disputes and controversies arising under this Public Offering shall be resolved through negotiations.

8.4. If the dispute or contradiction cannot be resolved through negotiations, then the dispute is resolved by court order in accordance with the current legislation of the Republic of Armenia.

9. FINAL PROVISIONS

9.1. The Public Offering Agreement comes into force upon the commencement of use of the Website and remains in effect until the parties fully fulfill their obligations.

9.2. In everything that is not provided by this Public Offer, the carrier, the user of the website, the passenger are guided by the current legislation of the Republic of Armenia.
